5 ILCS 140/5 Identification of Records Retained by Office 

Pursuant to 5 ILCS 140/5, our office identifies the following categories of public records as being records within our office’s possession or control: 

-    Electronic and physical communications involving our office which have been retained (excludes junk mail and similar unsolicited communications which do not concern public business).

-    Financial records associated with transactions conducted by our office.

-    Personnel records of staff employed by our office.

-    Internal office calendars, policy and procedure manuals, and similar organizational guides and aids.

-    Contents of open and archived case files, including, depending on the context of the case file, potentially: referral documents, filings, communications relevant to the case, evidence, transcripts, notes, and other attorney work product.

-    Privileged memorandums detailing formal opinions produced for our clients and similar archived attorney work product.

Pursuant to 5 ILCS 140/5, our office identifies the following organizational information to assist members of the public in identifying records to be requested. The vast majority of public records maintained by our office are contained within case files for organizational purposes. Case files are organized and may be identified by reference to a case number or by reference to a particular criminal defendant or, for non-criminal litigation, by reference to a particular opposing party. Non-litigation case files may be identified by reference to a case file number or by reference to a party to that non-litigation matter.
